Heading the firm’s complex litigation practice group, Gayle concentrates her practice on consumer class action, data breach cases and serious personal injury cases. She joined CaseyGerry more than 30 years ago and has become well known for representing injured clients in a wide range of high profile, multi-million- dollar cases.
Gayle has held leadership positions in several data breach Class Actions such as the Sony Gaming Networks, and YAHOO! Data Breach class action litigations. She is currently part of the team litigating the data breach incident involving Citrix Systems, and serves on the law and briefing committee in the Adkins v. Facebook data breach litigation. Gayle is also involved in leadership in the Apple Device Performance Litigation, Intel Corp. CPU Marketing, Sales Practices and Products Liability Litigation, ZF-TRW Airbag Product Liability Litigation, Hydroxycut Marketing and Sales Practices Litigation, and the Incretin Mimetics Product Liability Litigation.
In addition, recently, Gayle worked on several high-profile cases such as the Volkswagen diesel emissions scandal litigation which settled for a historic $14.7 billion, and the Wells Fargo Collateral Protection Insurance Class Action Suit, the Chrysler Ecodiesel litigation and the Audi litigation.
Gayle is highly involved in the community. She is the President of the San Diego County Bar Foundation (2020). She serves as a member of the Board of the Tom Homann Law Association Foundation and on the Board of Trustees for the California Western School of Law. She is a member of the Consumer Attorneys of California President’s Club, of the Leader’s Forum of the American Association.
Jennifer is a partner at MoginRubin LLP, a boutique firm with offices in San Diego and Washington DC, where she specializes in antitrust and privacy law. Prior to joining MoginRubin in 2017, she spent 10 years with a large international firm in New York City. Jennifer specializes in antitrust and data breach class actions, litigating commercial disputes, counseling M&A practitioners and their clients on competition and privacy issues, and CFIUS and antitrust regulatory filings. Jennifer currently represents a proposed nationwide class of consumers Atkinson v. Minted, Inc., a CCPA data breach case pending in the Northern District of California, as well as a nationwide class of independent ATM Operators in National ATM Council v. Visa, et al, an antitrust case awaiting class certification in the District of Columbia. She is an IAPP Certified Information Privacy Professional (CIPP/US).
Rosemary M. Rivas is a partner with the law firm Levi & Korsinsky, LLP, and leads the Firm’s Consumer Litigation Group. She has dedicated her legal career to representing consumers in complex, class action litigation involving data breaches and other privacy violations, false advertising claims, and defective products. She has been influential in recovering millions of dollars on behalf of consumers.
Ms. Rivas has worked on data breach and privacy right cases since 2007. Recently, she successfully represented Papyrus employees in a class action suit alleging the unauthorized disclosure of employee financial information. She currently represents Citrix employees whose personal and financial information was compromised. She also currently serves as Co-Lead Interim Class Counsel in a privacy rights case against Google involving geolocation tracking.
In a highly competitive application process, Judge Charles R. Breyer appointed Ms. Rivas to the Plaintiffs’ Steering Committee in In re: Volkswagen “Clean Diesel” MDL, Case No. 15-MDL-2672-CRB (JSC), which has resulted in unprecedented settlements totaling approximately $14.7 billion dollars. Ms. Rivas has served in a leadership role in a number of other class action cases and has been instrumental in obtaining favorable decisions on behalf of consumers.
Ms. Rivas is a recipient of the 2018 California Lawyer Attorney of the Year (CLAY) Award. The CLAY award was presented to her by the Daily Journal for her work in the Volkswagen litigation. The CLAY awards are given annually to outstanding California practitioners “whose extraordinary work and cases had a major impact on the law.” In 2019, Ms. Rivas was selected as a Northern California Super Lawyer. From 2009-2011, Ms. Rivas was selected as a Rising Star by Law & Politics Magazine, which recognizes the best lawyers 40 years old or under or in practice for ten years or less. In 2015, Bay Area Legal Aid presented her with the Guardian of Justice award, for her work achievements in the law and her role in helping direct cy pres funds to ensure equal access to the civil justice system.
