While state law developments have shared in the spotlight for privacy compliance over the last year, that has not slowed the pace of enforcement of existing sectoral federal privacy laws. This panel will examine enforcement highlights and trends pertaining to:
- The use of the Video Privacy Protection Act (VPPA) by the plaintiffs’ bar against digital video publishers and advertisers.
- Lessons learned from FTC Act enforcement actions, including allegations that certain uses of sensitive location data are “unfair” even if not deceptive under the FTC Act, and how the FTC views and enforces against the use of “dark patterns.”
- How state and federal regulators are using the enforcement tools at their disposal to drive compliance with federal law, such as record fines, data disgorgement, and requirements for executives (even if they move companies).
