Summary of Nevada Law Granting Consumers Right to Opt Out of Sale of Personal Information

The enactment of Nevada Senate Bill 220 (“SB-220” or the “Act”) on May 29, 2019 makes Nevada the second state after California to enact legislation granting consumers the right to opt out of the sale of personal information. SB-220 becomes effective on October 1, 2019, making it effective before California’s Consumer Privacy Act (“CCPA”) on January 1, 2020. The Act amends existing law and takes a narrower approach than the CCPA. Specifically, the Act only applies to online activities by “operators”; limits the definition of “consumer” to persons seeking or acquiring goods/services for personal, family, or household purposes – thereby excluding employee and business contact information; and takes a more limited approach than the CCPA to defining “sale.”
